GORILLASHIP TERMS & CONDITIONS

1. About These Terms

These Terms govern your use of GorillaShip and our receiving, storage, consolidation, packing and forwarding services. By creating an account, purchasing a plan, submitting goods to GorillaShip or requesting a shipment, you agree to these Terms. Nothing in these Terms affects statutory rights which cannot legally be excluded or restricted.

2. Our Service

GorillaShip provides services which may include receiving customer-owned goods; recording received goods; temporary storage; consolidation; repacking; preparation for dispatch; arranging shipment with third-party carriers; and associated administrative services.

GorillaShip is not the seller of goods sent to us on a customer's behalf and does not become the owner of those goods. Unless expressly stated otherwise, GorillaShip is also not itself the postal operator, courier or freight carrier responsible for transporting the final shipment.

 

3. Customer Accounts

Customers must provide accurate and current information. You are responsible for keeping your account details secure and for activity carried out through your account. You must promptly notify GorillaShip of any suspected unauthorised access.

 

4. Receiving Goods

Customers must use the receiving instructions supplied by GorillaShip. GorillaShip is not responsible for goods sent to an incorrect address; incorrectly addressed or identified; delivered somewhere other than GorillaShip; inadequately packaged by the original sender; prohibited under these Terms; damaged before receipt by GorillaShip; or incorrectly described by the customer or original sender.

Receipt by GorillaShip does not constitute confirmation of the authenticity, condition, value or legality of an item.

 

5. Inspection and Photographs

Where photographs, inspection or similar services are provided, they are intended as a reasonable visual aid only. Unless GorillaShip expressly agrees otherwise in writing, we do not authenticate, professionally grade or value collectibles. Failure to identify a concealed defect, counterfeit item, manufacturing defect or other problem which would not reasonably be apparent during the service provided does not make GorillaShip responsible for the item's underlying condition.

 

6. Storage

Items may be stored for the period permitted by the customer's plan or current GorillaShip pricing. Customers are responsible for requesting shipment within applicable storage periods. We may charge additional storage fees where published or agreed. We will give reasonable notice before treating goods as abandoned, disposing of them or taking another permitted action in relation to long-overdue goods.

 

7. Packing and Consolidation

Where GorillaShip packs or consolidates a shipment, we will use reasonable care and skill. We may select packaging that we reasonably consider appropriate for the nature, size and quantity of the goods unless a specific service has been agreed. Customers should notify us before shipment of exceptionally fragile, unusual or high-value goods requiring special handling.

 

8. Couriers, Transfer of Custody and Transit Risk

GorillaShip provides shipment-arrangement and forwarding services. The physical transportation of dispatched parcels is performed by independent third-party postal operators, couriers and freight carriers.

When a customer requests dispatch, the customer authorises GorillaShip to hand the shipment to the selected or applicable third-party carrier.

GorillaShip's physical custody and control of a shipment ends when the correctly prepared shipment is accepted into the possession or control of the relevant carrier.

Once accepted by the carrier, the parcel is transported by that independent third party and is subject to the carrier's applicable terms, exclusions, restrictions and compensation arrangements.

Subject to liability which cannot legally be excluded, GorillaShip will not be liable for loss, theft, delay, misdelivery, damage or deterioration occurring after the shipment has been accepted into the possession or control of the carrier. This includes parcels lost in transit; theft while in the carrier's network; courier handling damage; delivery delays; missed or failed delivery attempts; delivery to an incorrect location by the carrier; customs delays; carrier depot incidents; weather disruption; and acts or omissions of the carrier outside GorillaShip's control.

This exclusion does not apply to loss or damage caused by GorillaShip before transfer to the carrier, including where established to have resulted from GorillaShip failing to exercise the level of care and skill required by law when packing or preparing the shipment.

 

9. Carrier Claims

Where a shipment is lost or damaged while under a carrier's control, any claim will normally be subject to the carrier's terms, claim deadlines, evidence requirements, declared values, prohibited/restricted-item rules and compensation limits.

Where reasonably possible, GorillaShip may assist the customer with an eligible carrier claim. Assisting with a claim does not mean GorillaShip accepts liability for the loss or damage. GorillaShip does not guarantee that a carrier or insurer will accept or pay any claim. Any compensation received specifically for an accepted customer claim will be dealt with in accordance with the applicable service arrangements.

 

10. Insurance and Declared Value

Customers are responsible for deciding whether available carrier compensation or insurance is adequate for their goods. Where optional enhanced cover is available, customers are responsible for selecting it before dispatch and providing an accurate value. Declaring a value to GorillaShip does not itself create insurance or guarantee compensation. Items excluded by a carrier or insurer remain subject to those exclusions.

 

11. Customs, Duties and Taxes

The customer is responsible for providing accurate information required for customs declarations. Customers must not instruct GorillaShip to deliberately undervalue, falsely describe or misdeclare goods. The recipient is responsible for customs duties, import VAT, taxes, handling fees and similar charges unless expressly agreed otherwise. GorillaShip is not responsible for delays, seizures, penalties or additional charges arising from inaccurate information supplied by a customer or restrictions imposed by customs authorities.

 

12. Prohibited and Restricted Goods

Customers must not send goods that are illegal or prohibited by applicable law or by the relevant carrier. We may refuse, return, isolate or otherwise deal appropriately with prohibited, dangerous or suspicious goods. The customer is responsible for reasonable costs or losses incurred because they sent prohibited or incorrectly declared goods.

 

13. Customer-Supplied Information

The customer is responsible for ensuring that delivery addresses, names and contact details, customs information, item descriptions, declared values and shipment instructions are accurate and complete. GorillaShip is not responsible for losses caused by incorrect information supplied by the customer.

 

14. Fees

Current charges will be displayed on our website or otherwise communicated before the relevant service. Shipping charges may vary depending upon destination, carrier, weight, dimensions, service level and other factors. Customers must pay amounts due before goods are released where payment is required.

 

15. Subscriptions

Where a monthly subscription is offered, the price and included services will be displayed when the customer subscribes. Subscriptions continue according to the billing terms presented at purchase until cancelled. Cancellation stops future renewal but does not normally retrospectively refund services already supplied, subject to the customer's statutory rights.

 

16. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.

Subject to those rights and restrictions, GorillaShip will not be responsible for losses caused by circumstances outside our reasonable control; losses occurring while goods are in the custody or control of an independent carrier; loss of profit; loss of business; loss of opportunity; loss of anticipated savings; or indirect or consequential loss, to the extent such exclusions are permitted by applicable law.

For customers acting wholly or mainly for business purposes, additional reasonable limitations of liability may apply where expressly agreed.

Nothing in these Terms removes a consumer's statutory rights or excludes GorillaShip's responsibility where liability cannot lawfully be excluded.

 

17. Events Outside Our Control

We are not responsible for delay or failure caused by events outside our reasonable control, which may include carrier disruption; severe weather; industrial action; transport disruption; customs action; border closures; government restrictions; war or civil disturbance; fire or flood; major IT or telecommunications failure; or other comparable events. We will take reasonable steps to minimise disruption where practical.

 

18. Complaints

If you believe GorillaShip has made an error, contact us promptly at support@gorillaship.co.uk. Please provide your account details, relevant shipment information and an explanation of the issue.

 

19. Changes to These Terms

We may amend these Terms from time to time. Changes will apply prospectively from the date stated in the updated Terms, except where a change is required immediately by law or regulation. Changes will not remove rights that have already accrued under an existing contract where the law prevents us from doing so.

 

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

 

21. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory rights regarding where legal proceedings may be brought.
